Terms and Conditions

Terms and Conditions of INDIGIT: the rules that apply to the INDIGIT Subscription and to custom projects, including payment and ownership.

Last updated: 29 October 2026

1. Identity and scope

These Terms govern the relationship between the client and Evil Corporation, Unipessoal Lda., tax number (NIPC) 513815643, Freamunde, Paços de Ferreira, Portugal, which provides the services under the INDIGIT ® brand.

By engaging our services, the client accepts these Terms. If an accepted proposal or a contract signed by both parties says something different, the proposal or contract prevails.

The provisions of the Billing and Refunds and AI Data Policy pages form part of these Terms.

2. Services

  • INDIGIT subscription: a fixed monthly fee, with access to all services listed on the website, one active request at a time and unlimited requests during the month, in the order of priority the client sets.
  • Custom project: scope, price and timeline set out in a proposal the client accepts before we start.

3. Client obligations

  • Provide true and complete information, including billing details.
  • Provide in good time the content, access and approvals that the work depends on.
  • Warrant that they hold the rights to the texts, images, trademarks and other materials they give us.
  • Not use the services for content that is illegal, defamatory, offensive or that infringes third-party rights.

4. Third-party services

Domains, hosting, licences, app store accounts, platforms such as Shopify and paid advertising budgets are not included in our price. The client contracts and pays for these services directly with each provider, under that provider’s terms. We list these costs in the proposal or, for the INDIGIT Subscription, before we start work on each request.

5. Intellectual property

Once the corresponding price is paid in full, the economic rights in the code, design and files produced for the client, including source files, belong to the client.

Third-party and open-source components keep their own licences. Unless the client says otherwise, we may show the work in our portfolio, without disclosing confidential information.

6. Confidentiality

We treat as confidential the client information we access during the work, and we use it only to provide the services, except where the law or a competent authority requires its disclosure.

7. Data protection in projects

Where, in providing the services, we process personal data on the client’s behalf, the client is the controller and we act as processor under Article 28 GDPR. In that case, the parties sign a data processing agreement, which prevails over these Terms on that subject.

8. Liability

We do not guarantee business results, search engine rankings or citations in AI tools.

Except in cases of wilful misconduct or gross negligence, we are not liable for failures or changes in third-party services, for interruptions outside our control or for loss of profit. Nothing in these Terms limits liability for death or personal injury, or any other liability that the law does not allow us to limit.

9. Suspension and termination for breach

We may suspend the services or terminate the contract if the client seriously breaches these Terms or does not pay overdue invoices, after we give notice and a reasonable period to fix the situation. For overdue invoices, section 3 of the Billing and Refunds page applies.

10. Changes and governing law

We may update these Terms. Changes apply to new subscription periods and new proposals, and we notify active clients by email.

These Terms are governed by Portuguese law. Without prejudice to consumer protection rules, disputes are settled by the competent Portuguese courts. Consumers may also refer disputes to the alternative dispute resolution entities listed on our Alternative Dispute Resolution page, where their websites are listed.
